DMCA (Digital Millennium Copyright Act) Policy

Writing and Sending a Proper Notification

The DMCA offers a legal process through which you can request an Online Service Provider to disable access to a website where your copyrighted work(s) is being displayed without your authorization. This process comprises two key steps: (1) Drafting a Proper DMCA Notice and (2) Sending the Proper DMCA Notice to uptoearns.com's Designated Agent. To create a Proper DMCA Notice, include the following information:

  1. Identify yourself as the owner of copyrighted work or exclusive rights, or as a representative of the owner, and provide a physical or electronic signature.
  2. Specify the copyrighted work(s) that you believe are being infringed.
  3. Identify the material(s) allegedly infringing your copyrighted work by providing the web URL(s) on uptoearns.com containing the material(s).
  4. Share your contact information, including name, address, phone number, and business email address. If you're acting on behalf of the copyright owner, describe your affiliation.
  5. State that you have "a good faith belief that use of the aforementioned material is not authorized by the copyright owner, its agents, or the law."
  6. Confirm the accuracy of the information in the notice and assert, under penalty of perjury, that you are authorized to act on behalf of the infringed copyright owner.

To exercise your DMCA rights, send your Proper DMCA Notice to our email address "admin@uptoearns.com" and title the message as "DMCA NOTICE."

Notice and Takedown Procedure

uptoearns.com will adhere to the DMCA's procedures to protect the rights of copyright holders. Upon receiving a Proper DMCA notification, or when we otherwise become aware of copyright infringements, we will promptly remove or disable access to the infringing materials. Confirmation from us is not required for this action. Typically, uptoearns.com acts within 24 hours of notification; however, response times may vary based on individual cases and verification requirements.

Counter Notification

Users who believe their use of materials was lawful have the right to send a Proper Counter-notification to restore access to these materials. If we receive a counter notification, uptoearns.com will comply with the relevant DMCA provisions.

To create a Proper Counter Notice, include the following information:

  1. Identify the material with its description that was removed and mention its URL prior to removal.
  2. Assert, under penalty of perjury, the following details:
    • Name, address, phone number
    • You "have a good faith belief that the material was removed or access disabled as a result of mistake or misidentification of the material" and you "consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located."
  3. Sign the notification with a physical or electronic signature.

To exercise your DMCA rights, send your Proper Counter Notice to our email address "admin@uptoearns.com" and title the message as "COUNTER NOTICE."
